Deadly Grounds Coffee Canada Rewards Terms and Conditions

Effective Date: February 2024

PLEASE READ THESE TERMS OF USE CAREFULLY. BY PARTICIPATING IN THE
DEADLY GROUNDS COFFEE CANADA LOYALTY PROGRAMS (“DEADLY POINTS”
“DEADLY REWARDS”), YOU AGREE TO THE TERMS AND CONDITIONS OUTLINED IN
THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT
PERMITTED TO PARTICIPATE IN THE PROGRAMS.


Please review the Terms periodically to understand the terms and conditions that
apply to your access and participation in the Deadly Grounds Coffee Canada Loyalty
Programs. Deadly Grounds Coffee Canada reserves the right, and in its sole and
absolute discretion, to amend all or any portion of these Terms and any other
information relating to the Loyalty Programs and to suspend or terminate the Loyalty
Programs in whole or in part, at any time and without notice. If a Loyalty Program is
terminated, the Program Terms will also be terminated, and your Points (defined
below) shall expire upon termination of the Loyalty Program. Any amendment or
termination of the Deadly Grounds Coffee Canada Loyalty Programs Terms will be
effective immediately upon posting the amended Programs Terms to
www.deadlygroundscoffee.ca. By participating in any of the Loyalty Programs, you
acknowledge and accept that you waive any right to receive specific notice of such
amendment to the fullest extent permitted by applicable law.


Loyalty Programs and Eligibility


Deadly Grounds Coffee Canada has two loyalty programs. One is designed for in-store
purchases at our participating physical locations and the other is created for the sole
use of online purchases from www.deadlygroundscoffee.ca. While a person can be a
participant in both loyalty programs, points cannot be earned or combined on same
order. i.e. double dipping. A person cannot order online, collect points on the order,
then pick up and pay in-store and collect points again.

Loyalty Programs and Eligibility


At Deadly Grounds Coffee Canada, we offer two distinct loyalty programs: one for in-store purchases and another for online purchases. Please note that each program has specific eligibility criteria. While a person can be a participant in both loyalty programs,
points cannot be earned or combined on same order. i.e. double dipping. A person cannot order online, collect points on the order, then pickup and pay in-store and collect points again.


1. In-Store Loyalty Program:


Our in-store loyalty program is designed for customers who purchase at any participating Deadly Grounds Coffee Canada store. This program is exclusive to individuals who visit our physical store locations within Canada. By joining our in-store loyalty program, you can earn rewards, enjoy exclusive offers, and receive personalized perks tailored to your coffee preferences.

 

2. Online Loyalty Program:


Our online loyalty program caters to customers who purchase through our online store. This program is accessible to individuals who reside in specific countries where online ordering is available. To participate, you must create an online account on the DeadlyGrounds Coffee Canada website and purchase online while logged in. By joining our online loyalty program, you will earn points, unlock special promotions, and receive updates on new products and offers.

Both loyalty programs are designed exclusively for residents of Canada. However, the in-store program is specifically for customers who shop at our physical store locations, while the online program is available for individuals making online purchases in specific countries.

Earning Rules Specifications


Deadly Grounds Coffee Canada Loyalty Program members can earn points based on their eligible purchases. Each qualifying purchase made at Deadly Grounds Coffee Canada locations contributes to accumulating points in their loyalty account. The specific earning rate and calculation for points may vary and are subject to change at the discretion of Deadly Grounds Coffee Canada.


To earn points, members must ensure that their loyalty account is properly identified at the time of purchase. This may involve providing their loyalty account number, presenting a loyalty card, or providing the necessary information through the Deadly Grounds Coffee Canada mobile app, website or store point of sale. 


It is important to note that points will only be earned on eligible purchases. Eligible purchases refer to regular priced items or specific qualifying products as specified by Deadly Grounds Coffee Canada. Points will typically not be earned on discounted items, promotional offers, gift card purchases, or any other excluded products or services as determined by Deadly Grounds Coffee Canada.


Points earned through the Deadly Grounds Coffee Canada Loyalty Program are non-transferable and cannot be combined with points from other loyalty programs or accounts. Additionally, points may not be earned on purchases made before enrolling in the loyalty program or during periods of membership cancellation or suspension.


The accumulation of points does not guarantee any specific rewards or benefits. The value and redemption options for points earned through the Deadly Grounds Coffee Canada Loyalty Program will be outlined in the program's terms and conditions or communicated through official marketing materials.


Deadly Grounds Coffee Canada reserves the right to change the earning rules, point calculation, or redemption structure at any time and without prior notice. The loyalty program member is responsible for staying updated on any changes through the Deadly Grounds Coffee Canada website, mobile app, or customer communication channels.

Eligible purchases


Points can only be earned on qualifying purchases at Deadly Grounds Coffee Canada locations. Qualifying purchases include products available for sale at participating locations, including packaged coffee, tea and hot chocolate, beverages and baked goods.


Points will be earned based on the total amount spent on qualifying purchases. Points will not be earned on taxes, gratuities, delivery fees, or any other additional charges that may apply to the purchase.


Purchases made through third-party delivery services are not eligible for earning points in the loyalty program unless otherwise specified by Deadly Grounds Coffee Canada. Points cannot be earned on purchases made at other non-participating Deadly Grounds Coffee locations or any other retailers, even if they sell Deadly Grounds Coffee Canada products.


Deadly Grounds Coffee Canada reserves the right to determine which purchases qualify for earning points, and this may be subject to change without prior notice. Please refer to deadlygroundscoffee.ca or contact customer service for the most up-to-date information on eligible purchases.


The customer is responsible for ensuring that their loyalty program account is properly credited with the points earned from qualifying purchases. If any discrepancy or issue arises regarding points earned, the customer must promptly notify Deadly Grounds Coffee Canada for resolution. By participating in the loyalty program and making qualifying purchases, customers acknowledge and accept the terms and conditions regarding eligible purchases as outlined in this agreement.


Rewards


Points earned through the Deadly Grounds Coffee Canada Loyalty Program have a specified value that can be redeemed for various rewards. The exact value of points and the corresponding redemption options will be determined by Deadly Grounds Coffee Canada and may be subject to change.


The loyalty program may offer a range of rewards that members can redeem their points for, such as discounts on future purchases, exclusive promotions, or other special perks. The specifics of available rewards and their corresponding point values will be outlined in the Deadly Grounds Coffee Canada Loyalty Program terms and conditions or communicated through promotional materials.


When members are ready to redeem their points, they can typically do so through their loyalty account on the Deadly Grounds Coffee Canada website, mobile app, or by contacting customer support. The redemption process will depend on the specific procedures established by Deadly Grounds Coffee Canada.


Members should keep in mind that the number of points required for redemption and the availability of certain rewards may be subject to limitations. No transferable


Points, rewards, and membership within the Deadly Grounds Coffee Canada loyalty programs are non-transferable and can only be used by the account owner. Points earned and rewards redeemed in the loyalty program are personal to the customer and cannot be transferred or shared with any other person.


Customers are responsible for safeguarding their loyalty program account and ensuring that it is not accessed or used by any unauthorized individuals. Sharing of accounts, points, or rewards with others is strictly prohibited and may result in the termination of the customers loyalty program membership.


Deadly Grounds Coffee Canada reserves the right to investigate and take necessary actions against any instances of point or reward transfer, sharing, or misuse. This may include, but is not limited to, the cancellation of points, suspension or termination of the loyalty program account, and legal actions if deemed necessary. Any attempt to transfer or share points, rewards, or membership may be considered a violation of the loyalty program terms and conditions and could result in the forfeiture of all accumulated points and rewards.
Please note that this non-transferability clause applies to both physical and digital forms of the loyalty program, including physical loyalty cards, digital accounts, and mobile applications.


By participating in any Deadly Grounds Coffee Canada loyalty programs, customers acknowledge and accept that points, rewards, and membership are non-transferable and can only be used by the account owner, as outlined in this agreement.

Not Exchangeable for Cash


Points, rewards, and vouchers earned through the Deadly Grounds Coffee Canada loyalty program are not exchangeable for cash and hold no cash value. They are intended to be used exclusively within the loyalty program for eligible rewards and benefits.


The accumulation of points does not equate to the accumulation of monetary value. Points may not be used to purchase gift cards. Points are unique to the loyalty program and cannot be converted into cash or any other form of monetary compensation.Similarly, rewards and vouchers issued through the loyalty program cannot be redeemed for cash. They are redeemable only for specified goods as outlined in the
program terms and conditions.


Deadly Grounds Coffee Canada reserves the right to establish the value of points, rewards, and vouchers in relation to eligible rewards and benefits within the loyalty program. These values are subject to change at any time without prior notice. By participating in the Deadly Grounds Coffee Canada loyalty program, customers acknowledge and accept that points, rewards, and vouchers have no cash value and
cannot be exchanged for cash or any other form of monetary compensation, as outlined in the program terms and conditions.


Expiration

Points may be deemed forfeited if the customer’s Program account is inactive for twelve consecutive months or if the customer violates the terms and conditions set forth in this agreement.


Points and rewards may expire and must be redeemed before the specified time limit. Unless Deadly Grounds Coffee Canada states otherwise, the default expiration period for points is one year from the date of purchase. Customers are encouraged to check their account balance regularly and take note of any points nearing expiration. It is important to be proactive in redeeming points to ensure their value is not lost.


In addition to expiration, points may be deemed forfeited under certaincircumstances. If a customer's loyalty program account remains inactive for twelve consecutive months without any qualifying activity, the accumulated points may be forfeited.


Similarly, if a customer violates the terms and conditions set forth in the loyalty program agreement, points may be subject to forfeiture. It is essential for customers to review and comply with all the terms and conditions to maintain their eligibility for program benefits.


Alongside points, rewards earned through the loyalty program may also have expiration dates. It is important to redeem rewards before the specified time limit to ensure their usability. Expired rewards may not be reissued or reinstated. Deadly Grounds Coffee Canada reserves the right to modify or adjust expiration dates for points and rewards at any time, depending on program changes or other operational considerations. Any changes will be communicated to customers through various channels, such as email notifications, updates on the program website, or in-app notifications.


Customers are advised to regularly check for any updates regarding expiration dates and redemption requirements in order to maximize the value of their points and rewards.


By participating in the Deadly Grounds Coffee Canada loyalty program, customers acknowledge and accept that points and rewards may have specific time limits and must be redeemed before the specified expiration dates, as outlined in the programs terms and conditions.

Failure to adhere to these time limits may result in the loss of points and rewards.

Returns


Returns and exchanges of products purchased through the Deadly Grounds Coffee Canada loyalty program will be subject to our standard return policy. Please refer to our return policy for more information on the eligibility and process for returns. In the event of a return or exchange of a product that was purchased using a loyalty program, any points earned from that purchase may be deducted from your loyalty program account. This means the points associated with the returned or exchanged product will be removed from your point balance.


We strive to ensure a fair and consistent approach to returns within our loyalty program. If you have any specific questions or concerns regarding returns in relation to our loyalty program, please contact our customer support team for further assistance.

Participating Stores


a. The benefits, rewards, and points of the Deadly Grounds Coffee Canada loyalty program can only be redeemed at participating store locations. It is important to note that not all Deadly Grounds Coffee Canada locations may offer the loyalty program. To confirm if your local store participates in the program, please reach out to them directly or check the Deadly Grounds Coffee Canada website for a list of participating locations.


b. We recommend contacting your local Deadly Grounds Coffee Canada store to inquire about their participation in the loyalty program. Each store may have different policies and promotions in place, and it is best to confirm with them directly for accurate information regarding the loyalty program benefits and redemption options. Please note that the availability of the loyalty program may vary by store location, and Deadly Grounds Coffee Canada reserves the right to modify or discontinue the program at any time and without prior notice.

Termination Conditions

a. Deadly Grounds Coffee Canada retains the right to terminate the loyalty program at any time, without prior notice, and at its sole discretion. This means that Deadly Grounds Coffee Canada may choose to discontinue the loyalty program at any time for any reason.


b. If the loyalty program is terminated, any outstanding points or rewards earned by loyalty program members may no longer be redeemable. It is crucial to note that upon program termination, loyalty program members will have no further ability to use or redeem their accumulated points or rewards.


Deadly Grounds Coffee Canada will make reasonable efforts to notify loyalty program members in the event of program termination. However, it is the responsibility of loyalty program members to regularly check for any program updates or changes on the Deadly Grounds Coffee Canada website or through loyalty program communications.

Additional Benefits:


a. As a loyalty program member, you may enjoy additional benefits, exclusive offers, or promotions provided by Deadly Grounds Coffee Canada. These benefits may include special discounts, seasonal promotions, or limited-time offers exclusive to loyalty program members.


b. The information regarding these additional benefits and promotions will be communicated to members through the loyalty program channels. This may include email communication, mobile app notifications, or Deadly Grounds Coffee Canada website updates.

 

It is recommended to regularly check your loyalty program communications to stay informed about any potential additional benefits or promotions available to you as a loyalty program member. Dispute Resolution


a. Any disputes or claims that arise from or are related to the Deadly Grounds Coffee Canada loyalty program must be resolved exclusively through binding arbitration. This means that if there is a dispute or claim, both the loyalty program member and Deadly Grounds Coffee Canada agree to have the matter settled through arbitration rather than pursuing litigation in court.


b. Additionally, both parties, the loyalty program member and Deadly Grounds Coffee Canada, agree to waive their right to participate in class action lawsuits or class-wide arbitrations. This means that any disputes or claims must be pursued on an individual basis rather than as part of a group or class.


c. Deadly Grounds Coffee Canada will choose a neutral third-party arbitrator to administer the Arbitration Process. The arbitrator will review the facts and evidence presented by both parties and make a final and binding decision on the dispute or claim. The conclusion reached through arbitration cannot be appealed.


d. The arbitration process will generally be conducted under the rules and procedures set by the arbitration provider chosen by Deadly Grounds Coffee Canada. The specific details of the arbitration process, including the location and format (such as in-person or online), will be determined by the arbitration provider and communicated to the parties involved.


e. Both the loyalty program member and Deadly Grounds Coffee Canada agree to abide by the decision made through arbitration and fully cooperate in the arbitration process. This includes providing relevant information, attending any required meetings or hearings, and complying with necessary procedures.

To the fullest extent permitted by applicable law, by participating in the Loyalty Programs and earning loyalty points, you acknowledge and agree that Deadly Grounds Coffee Canada may modify the terms and conditions of the Loyalty Programs without providing individual notice to you. You are responsible for regularly reviewing the terms and conditions to stay informed about any changes. Your continued participation in the Loyalty Programs after any modifications will constitute your acceptance of the revised terms and conditions.
